On Friday, March 11, 2016, NHTSA published its final notice regarding its proposed "Recommended Best Practices for Protective Orders and Settlement Agreements in Civil Litigation." The notice recommends that litigants provide language in their protective orders and settlement agreements that allows the parties to disclose "relevant motor vehicle safety information to NHTSA and other applicable governmental authorities."
NHTSA's recommendations in the final notice are substantially the same as what the agency proposed last September, which Bowman and Brooke covered in a previous client alert.
