A 16-year-old male suffered a spinal cord injury, resulting in nerve damage and quadriplegia, when the ATV he was operating designed, manufactured, and distributed by the defendant, landed on his back after he was tossed from it as he made a left turn. The plaintiff contended that the defendant designed, manufactured, and distributed the ATV in a negligent manner, failed to design a rear differential to make it more stable, and failed to warn that the ATV was defective in its design and not safe for its intended purpose and use.
