Protective orders serve a crucial role in litigation, balancing the need for disclosure with the necessity of protecting sensitive commercial information. A strong protective order creates a framework that allows an appropriate exchange of documents while safeguarding commercially sensitive, confidential or proprietary information. One issue that is too frequently overlooked in negotiating a protective order is whether the protective order allows for sharing of documents outside of the case at issue.
